RELEASE, WAIVER, AND ASSUMPTION OF RISK AGREEMENT TERMS AND CONDITIONS OnaVelo ("OnaVelo") is based in Calgary, Alberta, Canada. OnaVelo offers bicycle trips for select groups and individuals. OnaVelo will make every reasonable effort to ascertain that: the OnaVelo staff and volunteers (“leaders”) are fully trained and qualified; trip participants under the age of 18 will be adequately supervised; and any equipment made available by OnaVelo or used in an activity has been inspected and is deemed to be appropriate, safe, and well maintained. OnaVelo expects participants to be enthusiastic, cooperative and appreciative of the opportunities afforded to them through our program. Activities sometimes operate under difficult and challenging conditions and OnaVelo expects participants to be cooperative and attentive at all times. The use of illegal drugs, and underage consumption of alcohol or cannabis is strictly forbidden. In consideration for the services of OnaVelo, its employees, leaders, officers, agents, and volunteers (including but not limited to school districts, municipalities, churches, clubs, campgrounds, sponsors, chaperones, local guides and any employee, their heirs, administrators, agents or associates thereof), collectively referred to herein as "OnaVelo", I, on behalf of myself and/or as the parent or guardian of the minor child participating in the OnaVelo activity, and our heirs, agree as follows: I understand and am aware that biking on and off road, including bike packing and bicycle touring and mountain biking and related activities including, among others, bicycle mechanics and use of tools and use of equipment (referred to herein as "Activity"), and transportation to and from such Activity, are HAZARDOUS ACTIVITIES involving INHERENT AND OTHER RISKS of injury to any and all parts of the body. I further understand that injuries in the Activity are a COMMON AND ORDINARY OCCURRENCE, and I have made a voluntary choice for myself and/or the minor child registered to ACCEPT AND ASSUME ALL RISKS OF INJURY OR DEATH that might be associated with or result from this Activity. I understand that OnaVelo reserves the right to remove any participant at any time without any refund if the participant violates any law, deviates from the program or trip itinerary, endangers the lives of other participants or their own life, or consistently disregards trip leader’s instructions. I recognize that medical or dental care may be necessary for me and/or my minor child. I AUTHORIZE OnaVelo and LEADER(S) TO RENDER FIRST AID OR EMERGENCY CARE, within the scope of the current or previous certification of the trip leader(s). I agree to notify the leader, and consent to and permit emergency medical treatment. In addition, I authorize OnaVelo to call for medical or dental care for myself and/or my minor child if, in the opinion of OnaVelo, medical or dental care is needed. I agree that I will use good judgment, be self-reliant and stop to request assistance if I am unsure of my ability to complete any segment of the Activity safely. In extreme situations, I understand and agree not to wait for assistance exclusive to the support provided by OnaVelo. I understand that if I leave before the posted departure date or travel a course different from the designated trip plan, I will not receive the services as published or advertised. I further agree to pay all fees associated with my deviation from the original plan and route. I attest that I am physically fit and have sufficiently prepared for the completion of the Activity entered. I also agree to wear an ANSI, CPSC or SNELL approved bicycle helmet at all times when riding a bicycle during this Activity. I attest that I will abide by the rules and policies of OnaVelo programs and all applicable country, state, provincial, local and municipal laws, including vehicle laws. I further understand that I will not be reimbursed for airline fees due to change in itinerary or program cancellation or compensated for the theft of any personal gear. I hereby release and discharge OnaVelo from any and all liability, causes of action, suits, debts, contracts, agreements, claims and demands whatsoever as a result of my participation in an OnaVelo Activity. I further agree not to make a claim or sue for injuries or damages relating to this Activity, even if caused by negligence. I understand and agree that this Agreement is intended to be as broad and inclusive as is permitted by law, and if any portion is held invalid, the balance shall continue in full legal force and effect. I agree that no oral representations, statements or inducements apart from this Agreement have been made. Guaranteed to Go OnaVelo trips require a minimum number of guests to run and are not guaranteed until that number is reached. In the event that a trip has low registrations, we will notify guests at least 90 days prior to departure with the option to select a different date with more guests booked or to get a full refund of any payments toward the trip you registered. Please don’t reserve airfare before confirming your trip. Cancellation Policy | 2024/2025 Pre-Confirmation “Guaranteed to Go” Cancellation: If you cancel your trip before it is confirmed or "Guaranteed to Go," you will receive a full refund of your Trip Deposit and any additional payments. Post-Confirmation “Guaranteed to Go” Cancellation: If you cancel your trip after it is confirmed or "Guaranteed to Go," please note that your Trip Deposit is non-refundable. However, it may be transferable to another trip or individual. Any payments made in addition to your Trip Deposit will be refunded in full. Please be aware that once a trip is confirmed, we incur costs associated with various arrangements. Therefore, timely cancellations help minimize financial impact on both the traveler and OnaVelo. OnaVelo also reserves the right to cancel any trip using our discretion if the safety of our travellers or staff should be compromised. In the event of cancellation, OnaVelo is not responsible for any loss incurred for non-refundable travel costs. In this case, a refund of payments received by OnaVelo will constitute the full and final settlement.
